1. Binding Master Service Agreement & Acceptance of Risk

This Master Terms of Service and Legal Agreement ("Agreement") forms a legally binding contract governing your access to and use of the Dr. PS mobile and web application, its clinical decision-support modules, metabolic tracking frameworks, AI Coach conversational interface, photo recognition services, prescription OCR readers, and related services ("Service" or "Application").

The Application is developed, maintained, and operated by Dr. Pranav Shimpi, his clinical staff, healthcare associates, affiliated medical team, software development partners (including Pravisio), and his clinical practice firm The Rehab Lab ("Service Operator", "we", "us", or "our").

By creating an account, selecting "I agree", or using any feature of the Application, you ("User", "you", or "your") affirm that you are at least 18 years of age or possess legal parental/guardian consent, and that you have read, understood, and unconditionally agreed to be legally bound by every clause contained in this Agreement. If you do not agree, you must immediately cease all access to the Service.

2. Educational & Self-Monitoring Scope (Strict Non-Medical Disclaimer)

Educational & Lifestyle Orientation: All data, estimations, caloric values, macronutrient distributions, meal quality ratings, metabolic insights, fasting schedules, habit suggestions, and conversational outputs generated by or contained within the Application are provided strictly for general educational, self-monitoring, informational, and wellness management purposes only.

No Clinical Advice or Doctor-Patient Relationship via Software: The Application, its software logic, algorithmic meal scoring, automated responses, and AI Coach modules DO NOT constitute medical advice, clinical diagnosis, formal treatment planning, clinical triaging, or official medical prescriptions. Interactive usage of this Application does NOT establish a doctor-patient relationship between you and Dr. Pranav Shimpi or any associated clinician of The Rehab Lab unless a formal, independent, in-person or direct clinical consultation is separately established outside this automated software framework.

Mandatory Professional Consultation: You are strictly instructed to consult directly with Dr. Pranav Shimpi, your designated clinician at The Rehab Lab, or your personal primary care physician prior to initiating any dietary alterations, calorie restrictive regimens, fasting schedules, exercise programs, supplement additions, or medication dosage adjustments. Never disregard professional medical advice or delay seeking clinical evaluation due to content, ratings, or suggestions encountered within this Application.

3. Complete Release of Liability, Hold Harmless & Indemnification

To the maximum extent permitted under applicable municipal, state, national, and international laws, you explicitly and irrevocably agree to defend, indemnify, release, and hold harmless Dr. Pranav Shimpi, his clinical staff, nursing personnel, nutritionists, physiotherapists, team members, professional associates, software architects, corporate entities, Pravisio, and his clinical practice firm The Rehab Lab, as well as their respective heirs, successors, and assigns (collectively, the "Indemnified Parties"), from and against any and all legal actions, administrative claims, lawsuits, demands, liabilities, damages, judgments, losses, costs, penalties, health complications, personal injuries, or financial expenses (including reasonable legal fees) arising directly or indirectly from:

• Your reliance on, interpretation of, or action taken based upon any calculation, meal score, caloric estimate, AI response, or health recommendation provided within the Application.
• Any dietary changes, exercise activities, fasting practices, supplement regimens, or lifestyle modifications adopted by you during or after using the Application.
• Any technical errors, software bugs, calculation discrepancies, data loss, server downtime, security interruptions, or delayed notifications within the Service.
• Your failure to seek immediate professional medical attention during an acute health incident or emergency.

4. Integrated Third-Party AI Services & Google Cloud Infrastructure Terms

Google Cloud Platform & Gemini AI Integration: The Application incorporates cutting-edge Artificial Intelligence capabilities powered by Google LLC and Google Cloud services ("Google Cloud / Gemini API"). By utilizing features that involve natural language processing, photo meal recognition, or prescription OCR scanning, you acknowledge and agree that your submitted inputs are processed securely through Google Cloud infrastructure in accordance with Google's Generative AI Additional Terms of Service, Acceptable Use Policies, and Privacy Protocols.

Data Processing Disclosures: You acknowledge that text prompts, uploaded meal photographs, handwritten notes, and prescription images submitted to the Application are processed programmatically by multi-modal machine learning models to generate natural language explanations and nutritional estimations.

5. Artificial Intelligence Characteristics, Nuance, Probabilistic Models & Hallucinations

Probabilistic Operation & Inherent AI Limitations: Artificial Intelligence systems rely on probabilistic statistical algorithms and neural networks. While engineered with high standards of contextual prompts and medical guidelines, generative AI models can experience technical phenomena known as AI "hallucinations"—generating confident yet incorrect, inaccurate, out-of-context, incomplete, or unexpected outputs, including imprecise caloric/macronutrient values, misread handwriting on prescriptions, or erroneous ingredient recognitions.

Nuance & Context Sensitivity: AI models lack human clinical judgment, personal physical examination capabilities, real-time diagnostic instinct, and complete physiological context. Suggestions provided by the AI Coach are derived solely from user-provided data inputs and general training patterns.

6. Mandatory User Vigilance & Critical Evaluation Protocol

Duty of Critical Review: You explicitly agree that you will not treat any output generated by the AI Coach or automated analysis modules as definitive truth or absolute medical directive. You maintain an active duty to review, evaluate, and critically question all information presented by the Application.

Suspicious or Anomalous Output Procedure: If you observe any output, meal recommendation, dosage summary, or calculation that appears unusual, contradictory, extreme, suspicious, or inconsistent with common sense or prior clinical advice, you MUST IMMEDIATELY REFRAIN from acting upon such information. You agree to notify our support or clinical team and verify the information with a qualified medical professional prior to taking any health or dietary action.

7. Complete User Autonomy & Exclusive Responsibility for Health Decisions

You acknowledge and agree that you retain 100% full, absolute, and sole decision-making responsibility for all your health choices, nutritional choices, physical workouts, hydration levels, medication schedules, and metabolic routines. The Application and AI Coach serve solely as self-directed tracking tools and suggestive reference guides. Every decision to adopt, modify, or reject a suggestion is made voluntarily and autonomously by you at your own risk.

8. Emergency Medical Exclusions & Urgent Care Protocol

STRICT EMERGENCY EXCLUSION: THE APPLICATION IS NOT AN EMERGENCY RESPONSE SYSTEM.

If you experience acute, severe, or sudden symptoms—including but not limited to severe chest pain, radiating arm/jaw pain, acute shortness of breath, sudden numbness, weakness or facial drooping, loss of consciousness, severe allergic reactions, acute abdominal pain, or thoughts of self-harm—you MUST NOT use this Application or wait for an AI Coach response.

You must immediately dial national emergency dispatch numbers (112 in India, 911 in the United States, 999 in the United Kingdom) or proceed immediately to the nearest hospital emergency department.

9. Health Data Privacy, Local Storage Security & Information Use

Confidentiality & Care Coordination: Your logged meals, metabolic metrics, laboratory entries, and health history are stored securely and used exclusively to personalize your application experience, calculate progress indicators, and facilitate care coordination with Dr. Pranav Shimpi and your coaching team at The Rehab Lab.

No Commercial Sale of Health Data: We do not sell, rent, lease, or monetize your personally identifiable health information or logged data to third-party advertising or marketing brokers.

Local Caching & Device Security: Certain session details and preference tokens are cached locally on your device for performance optimization. You are responsible for maintaining passcode or biometric security on your mobile or computing device to prevent unauthorized local access.

10. Disclaimer of Warranties, Severability & Governing Law

"AS IS" and "AS AVAILABLE" Disclaimer: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Entire Agreement & Revisions: This Agreement constitutes the complete and exclusive agreement between you and the Service Operator regarding the Application. We reserve the right to revise these Terms periodically. Your continued use of the Application following published updates signifies binding acceptance of the updated Agreement.
